Contractual risk transfer and insurance management are critical aspects of any successful risk management program. This session is designed primarily for contractors that regularly subcontract work and/or engage lower-tier service providers. The discussion will focus on critical issues to consider in properly managing the downstream transfer of risk through indemnification, insurance, and associated risk transfer language contained in subcontracts, trucking, and vendor agreements. Examples of common failures will also be illustrated.

  • Understand critical contract language necessary for proper risk transfer and lower-tier entity insurance policy response
  • Recognize common failures in the risk transfer and insurance process and how to eliminate or reduce these types of failures
  • Review various general liability additional insured endorsements and implications to the lower-tier insurance coverage that may or may not respond on your behalf
  • Become aware of challenges facing the industry and recent legal interpretations and challenges that can negatively impact business if not properly addressed
  • Obtain practical resources and tools to assist in risk management efforts
